Ph.D. Dissertation Defense on the Impact of Legal Objectives (Maqāṣid al-Fiqh)
Under the patronage of the President of the University of Fallujah, Prof. Dr. Ahmed Suleiman Hamad, and under the supervision and follow-up of the Dean of the College of Islamic Sciences, Prof. Dr. Mohammed Jassim Abdul, the public defense of the doctoral student Aisha Alaa Mohammed from the Department of Sharia – College of Islamic Sciences / University of Fallujah was held on Monday morning, October 13, 2025, for her dissertation entitled:
“The Impact of Legal Objectives (Maqāṣid al-Fiqh) on Guiding Fatwas Toward Legal Concessions.”
The defense took place in the main hall of the College of Islamic Sciences.
The examining committee consisted of the following esteemed professors:

- Prof. Dr. Mohammed Ahmed Matar – Member
- Assoc. Prof. Dr. Mohammed Ali Hussein – Member

- Prof. Dr. Hatem Abdullah Shweish – Member and Supervisor
Objectives of the Dissertation:
This dissertation aims to clarify the status and significance of the legal objectives (Maqāṣid al-Fiqh), emphasize the necessity of their study and comprehension of their hierarchical wisdom, and stress the importance of considering these objectives when issuing legal rulings. It further seeks to link the overarching meanings of Islamic law with its specific textual evidences, demonstrating the profound influence of maqāṣid in guiding jurists to adopt legal concessions (rukhaṣ).
Key Findings:
The dissertation reached several conclusions, the most important of which is that legal objectives constitute a part of a comprehensive system of maqāṣid, encompassing various types and categories in a coherent structure that reflects the divine wisdom behind human servitude. It also concluded that maqāṣid play a vital role in establishing rulings for new issues (nawāzil) and in issuing contemporary fatwas.
After an in-depth discussion by the members of the examining committee, the dissertation was accepted with a grade of “Pass with Distinction.”
