Objectives of the Thesis
This thesis aims to collect and examine the jurisprudential issues in which two authoritative opinions (wajhan) were reported within the Shafi‘i school regarding matters discussed in the chapters of marriage and prohibited and permissible marriages in Al-Bayan by Al-‘Umrani. The study seeks to provide jurists and researchers with a clearer understanding of the diversity of legal reasoning within a single school of law, to investigate the evidences supporting the various opinions, and to compare these views with those of other Islamic legal schools, particularly in light of the large number of jurists who contributed independent legal opinions within the Shafi‘i tradition.
Major Findings
The study reached several important conclusions, the most notable of which are:
- Al-Bayan is regarded as one of the most significant works that carefully records and preserves the multiple juridical opinions within Islamic legal discourse.
- The diversity of opinions and legal perspectives represents a means of broadening the scope of juristic reasoning and enriching scholarly understanding of jurisprudential issues.
Following an extensive discussion of the thesis by the examining committee, the thesis was accepted with the grade of Pass.
