The thesis, entitled:
“Juristic Issues in Which Two Opinions Are Reported within the Shāfiʿī School in Al-Bayān by العمراني (d. 558 AH), from the Chapter on Insolvency to the Chapter on Interdiction, and Their Impact on Contemporary Fatwas – A Comparative Study”
The examination committee consisted of the following professors:
- Prof. Dr. Majid Saleh Ibrahim – Chair
- Asst. Prof. Dr. Mohammed Najeeb Hamadi – Member
- Asst. Prof. Dr. Ahmed Rasheed Thameel – Member
- Prof. Dr. Nu‘man Sarhan Atiyah – Member and Supervisor
Objectives of the Thesis:
This thesis aims to compile the juristic issues in which multiple opinions (wujūh) are reported within a single school, specifically those found in the chapters from insolvency (taflīs) to interdiction (ḥajr) in Al-Bayān by al-‘Umrānī. The study seeks to enable jurists to access the wide range of juristic opinions within the Shāfiʿī school, examine their evidences, and present the various viewpoints—particularly given the large number of authorities who articulated different opinions within the school of Imam al-Shāfiʿī (may Allah have mercy upon him)—and subsequently compare them with the views of other legal schools.
Key Findings:
The study reached several conclusions, the most prominent of which is that Al-Bayān is among the most significant works that meticulously transmitted the multiple juristic opinions within legal issues. Furthermore, the diversity of statements and opinions serves as a means of broadening the scope of juristic reasoning in legal matters.
Following an extensive discussion by the examination committee, the thesis was approved with the grade: Pass.
