The thesis, entitled:
“Juristic Issues in Which Two Opinions Were Reported within the Shafi‘i School in Al-Bayan by Al-‘Umrani (d. 558 AH), from the Book of Loan to the Book of Pre-emption, and Their Impact on Contemporary Fatwas – A Comparative Study”,
took place in the Central Hall of the College of Islamic Sciences.
The examination committee consisted of the following professors:
- Prof. Dr. Nu‘man Sarhan Atiyah – Chair
- Prof. Dr. Ali Mansour Ali – Member
- Asst. Prof. Dr. Mahmoud Khalaf Hammadi – Member
- Prof. Dr. Mohammed Najeeb Hammadi – Member and Supervisor
Objectives of the Thesis:
This thesis aims to compile the multi-opinion juristic issues within a single school of law, specifically those discussed from the Book of Loan to the Book of Pre-emption in Al-Bayan by Al-Umrani. It seeks to enable jurists to understand the nature of the diversity of opinions within the school, examine the evidences, and present the various viewpoints, given the abundance of opinion-holders within the school of Al-Shafi‘i (may Allah have mercy on him), and subsequently compare them with the views of other legal schools.
Key Findings:
The study reached several conclusions, the most prominent of which is that Al-Bayan is considered one of the most important works that documented multiple juristic opinions within legal issues. Furthermore, the diversity of statements and viewpoints serves as a means of broadening the scope of juristic reasoning in legal matters.
Following an extensive discussion by the examination committee, the thesis was approved with the grade of “Pass.”
