Objectives of the Dissertation:
This dissertation aims to identify the jurisprudential issues in which there are two opinions according to the Hanbalis in Al-Mughni by Ibn Qudamah (d. 620 AH), from the Book of I‘tikaf to the Book of Pledge, analyze their impact on contemporary fatwas, and study them through a comparative jurisprudential approach.
Main Findings:
One of the key findings of the dissertation is that Al-Mughni by Ibn Qudamah is among the most important and authoritative works—not only in Hanbali jurisprudence but also in comparative jurisprudence in general. Studying it broadens the horizons of students of knowledge and strengthens their scholarly aptitude, enabling them to adopt whichever opinion they deem most correct, based on knowledge and sound guidance.
After an in-depth discussion by the committee members, the dissertation was accepted with the grade of "Pass with Distinction".
