(The Jurisprudential Issues in Which Two Views Were Reported among the Shafiʽis in Al-Bayan by Al-ʽImrani (d. 558 AH), from the Book of Agency to the Book of Lending, and Their Impact on the Fatwas of Contemporary Scholars – A Comparative Study).
The defense was held in the Central Hall of the College of Islamic Sciences.
The examining committee consisted of the following professors:
- Prof. Dr. Nuʽman Sarhan Atiya – Chair
- Prof. Dr. Nahla Ashour Mansi – Member
- Assoc. Prof. Dr. Mohammed Hadi Talal – Member
- Assoc. Prof. Dr. Saʽdi Jasim Hammoud – Member and Supervisor
Objectives of the Thesis:
This thesis aims to collect jurisprudential issues that involve multiple views within the same school, specifically those issues discussed between the chapters of Agency and Lending in Al-Bayan by Al-ʽImrani. The purpose is to provide jurists with access to a vast range of opinions within the Shafiʽi school, examine their evidences, and present various perspectives, given the large number of scholars who contributed to the multiplicity of views within the Shafiʽi madhhab. It also aims to compare these with the opinions of other Islamic schools of law.
Key Findings:
The study reached several conclusions, the most important of which is that Al-Bayan is one of the most significant works concerned with recording the multiplicity of views in jurisprudential issues. Furthermore, the differences in opinions and views serve as a means to broaden the scope of ijtihad in jurisprudential matters.
After a thorough discussion by the examining committee members, the thesis was accepted with the grade of “Satisfactory/Pass with Requirements Fulfilled.”
