Objectives of the Thesis
This thesis aims to collect and study the juristic issues in which two opinions were reported within the same school of law concerning the topics discussed from the Book of Racing and Archery to the Book of the Foundling in Al-Bayan by Al-‘Umrani. The study seeks to provide jurists and researchers with a deeper understanding of the diversity of juridical opinions within a single legal school, examine the evidences supporting these opinions, evaluate the various viewpoints, and compare them with the positions of other Islamic legal schools, particularly in light of the large number of jurists who developed independent legal perspectives within the Shafi‘i tradition.
Main Findings
The study reached several significant conclusions, most notably that Al-Bayan is among the most important works that carefully documented the multiplicity of juridical opinions on legal issues. It also concluded that the diversity of opinions and juristic perspectives serves as a means of broadening the scope of legal reasoning and scholarly ijtihad in jurisprudential matters.
Following an extensive discussion by the examination committee, the thesis was accepted with the grade of Satisfactory.
