Master’s Thesis Defense

Under the patronage of the President of the University of Fallujah, Prof. Dr. Ahmed Suleiman Hamd, and under the supervision and follow-up of the Dean of the College of Islamic Sciences, Prof. Dr. Mohammed Jassim Abd, the public defense of the Master's thesis submitted by Ms. Asmaa Fadel Salem, from the Department of Sharia, College of Islamic Sciences, University of Fallujah, was held on the morning of Thursday, 16 July 2026.

Her thesis was entitled:

"Juristic Issues in Which Two Opinions Are Reported within the Hanbali School in Al-Mughni by Ibn Qudamah (d. 620 AH): From the Book of Pre-emption (Al-Shuf‘ah) to the Book of Leases (Al-Ijarat) – A Comparative Study."

The defense took place in the Central Hall of the College of Islamic Sciences.

The examination committee consisted of:

  • Prof. Dr. Kareem Zuhalif Jazaa – Chair
  • Asst. Prof. Dr. Mujahid Mahmoud Ismail – Member
  • Asst. Prof. Dr. Saif Abdulwahab Abdulrazzaq – Member
  • Prof. Dr. Omar Ahmed Abbas – Member and Supervisor

Research Objectives:

The thesis aims to collect and examine the juristic issues in which two opinions are reported within the Hanbali school in Al-Mughni by Ibn Qudamah (d. 620 AH), covering the chapters from the Book of Pre-emption (Al-Shuf‘ah) to the Book of Leases (Al-Ijarat), and to analyze them through a comparative juristic study with the other Islamic schools of law.

Major Findings:

The study concluded that Al-Mughni contains a considerable number of juristic issues featuring two recognized opinions within the Hanbali school, demonstrating the diversity of Ibn Qudamah's method of presentation. It also revealed the use of a variety of legal-theoretical (usuli) and juristic terminologies among Hanbali scholars. Furthermore, the research highlighted areas of convergence between the Hanbali and Shafi‘i schools in several opinions, while identifying issues in which the Hanbali school adopted distinctive positions. The findings also showed similarities in the methodology of legal reasoning employed by both schools, with the examined opinions being predominantly based on rational argumentation and the general principles of Islamic law.

Following an extensive discussion by the examination committee, the thesis was approved with the grade of "Pass."
