Master’s Thesis Defense

Under the patronage of the President of the University of Fallujah, Prof. Ahmed Suleiman Hamad, and under the supervision and follow-up of the Dean of the College of Islamic Sciences, Prof. Mohammed Jassim Abd, the public defense of the Master's thesis submitted by Sulaf Sarhan Dhiab, from the Department of Sharia, College of Islamic Sciences, University of Fallujah, was held on the morning of Wednesday, July 15, 2026, in the Central Hall of the College of Islamic Sciences.

The thesis was entitled:

"Juristic Issues in Which Two Opinions Exist within the Shafi'i School in Al-Bayan by Al-'Imrani (d. 558 AH): From the Book of Wills to the Bequest of the Benefit of a Slave – A Comparative Study."

The examination committee consisted of:

  • Prof. Majid Saleh Ibrahim – Chair
  • Prof. Abbas Ali Mahmoud – Member
  • Assoc. Prof. Bilal Saud Jaber – Member
  • Prof. Kareem Zuhlaf Jazaa – Member and Supervisor

Thesis Objectives:
This thesis aims to compile the juristic issues in the chapter on wills (Wasaya) in Al-Bayan by Al-'Imrani in which two authoritative opinions are reported within the Shafi'i school. It seeks to enable jurists and researchers to examine the diversity of legal opinions within the school, investigate the evidences supporting each view, evaluate the different juristic positions, and compare them with the opinions of other Islamic schools of law, particularly in light of the large number of Ashab al-Wujuh (jurists responsible for developing authoritative legal opinions) in the Shafi'i tradition.

Key Findings:
The study concluded with several significant findings, most notably that Al-Bayan is among the most important works documenting the multiple juristic opinions found within the Shafi'i school. It also demonstrated that the diversity of opinions and legal viewpoints serves as a means of broadening the scope of juristic reasoning (ijtihad) in legal issues rather than constituting contradiction.

Following an extensive discussion by the examination committee, the thesis was accepted with the grade of Pass.
