Thesis Objectives:
This thesis aims to compile the juristic issues in which two opinions were reported among the jurists of the Shafi‘i school regarding the matters discussed from the Book of the Foundling to the Book of Wills in Al-Bayan by Al-‘Umrani. The study seeks to enable jurists and researchers to examine the diversity of legal opinions within the school, investigate the evidences, and analyze the presented views, given the large number of scholars who contributed various legal perspectives within the Shafi‘i madhhab. It also compares these opinions with the views of other Islamic schools of jurisprudence.
Key Findings:
The study reached several conclusions, most notably that Al-Bayan is considered one of the most important works concerned with transmitting multiple juristic opinions on legal issues. It also concluded that the diversity of opinions and legal perspectives serves as a means of broadening the scope of ijtihad in jurisprudential matters.
After an extensive discussion by the examination committee, the thesis was approved with a grade of “Pass.”
