Under the patronage of the esteemed President of the University of Fallujah, Prof. Dr. Ahmed Suleiman Hamad, and under the supervision and follow-up of the esteemed Dean of the College of Islamic Sciences, Prof. Dr. Mohammed Jassim Abdul, the public defense of the master's thesis by the student Maryam Hussein Nasser, Department of Sharia – College of Islamic Sciences / University of Fallujah, was held on the morning of Tuesday, August 12, 2025.
Her thesis is entitled:
“Jurisprudential Issues with Two Opinions among the Shafiʽis in the Book Al-Bayan by Al-ʽUmrani (d. 558 AH), from the Chapter on Musarrat and Defect-Based Return up to the Chapter on Disagreement between Buyers and Sellers and the Perishing of the Sold Item, and Their Impact on Contemporary Fatwas – A Comparative Study.”
The defense took place in the main hall of the College of Islamic Sciences.
The discussion committee consisted of the following professors:
- Prof. Dr. Mohammed Ibrahim Abdul-Majid – Chair
- Prof. Dr. Moaaz Abdul-Alim Al-Saadi – Member
- Asst. Prof. Dr. Saif Abdul-Wahab Abdul-Razzaq – Member
- Prof. Dr. Omar Ahmed Abbas – Member and Supervisor
Thesis Objectives:
This thesis aims to compile the multi-faceted jurisprudential issues within a single school of thought in Al-Bayan by Al-ʽUmrani, enabling jurists to access a large body of variant opinions within the Shafiʽi school, examine the evidence, and present views—given the large number of opinion-holders in the Shafiʽi madhhab (may Allah have mercy on him)—and then compare them with the views of other schools of thought.
Key Findings:
The study reached several conclusions, the most notable of which are:
- Al-Bayan is one of the most important works concerned with recording multiple views on jurisprudential issues.
- The diversity of statements and opinions is a means of expanding the horizons of ijtihad in jurisprudential matters.
Following an in-depth discussion of the thesis by the committee members, the thesis was accepted with the grade of "Pass with Distinction".
