The thesis is entitled:
“Jurisprudential Issues with Two Opinions in the Shafi‘i School in Al-Bayan by Al-‘Umrani (d. 558 AH), from the Chapter on Legal Interdiction (Al-Hajr) to the Book of Liability (Al-Dhaman), and Their Impact on Contemporary Fatwas – A Comparative Study.”
The defense took place in the central hall of the College of Islamic Sciences.
The discussion committee consisted of the following esteemed professors:
- Prof. Dr. Omar Ahmed Abbas – Chair
- Prof. Dr. Issa Ahmed Mahal – Member
- Assoc. Prof. Dr. Saadi Jassim Hammoud – Member
- Prof. Dr. Amjad Murakib Dawood – Member & Supervisor
Thesis Objectives:
This thesis aims to compile jurisprudential issues that have multiple viewpoints within a single school of thought, enabling jurists to access a large body of opinions within the Shafi‘i school, examine the evidences, and present reasoned views—especially given the abundance of such variant opinions in the Shafi‘i school (may Allah have mercy on him)—and then compare them with the views of other schools.
Key Findings:
The study reached several conclusions, the most important of which is that Al-Bayan is one of the most significant works that highlight the transmission of multiple viewpoints on jurisprudential issues. Furthermore, the divergence of statements and opinions serves only as a means to broaden the scope of ijtihad in jurisprudential matters.
After extensive discussion by the committee members, the thesis was accepted with the grade “Satisfactory” (Mustawfī).
