Master’s Thesis Defense
Under the patronage of the President of the University of Fallujah, Prof. Dr. Ahmed Suleiman Hamad, and under the supervision and follow-up of the Dean of the College of Islamic Sciences, Prof. Dr. Mohammed Jassim Abdul, the public defense of the Master’s student Abdulrazaq Hammadi Fayadh, Department of Sharia – College of Islamic Sciences / University of Fallujah, was held at noon on Tuesday, 19/8/2025, for his thesis entitled:
“The Jurisprudential Issues with Two Opinions in the Shafi‘i School in al-Bayan by al-‘Umrani (d. 558 AH), from the Chapter of Disagreement between the Contracting Parties and the Perishing of the Sold Item up to the Chapter of Pledge, and Their Impact on Contemporary Fatwas – A Comparative Study.”
The defense took place in the Central Hall of the College of Islamic Sciences.
The examination committee consisted of the following esteemed professors:

- Asst. Prof. Dr. Mohammed Adel Shafi – Member

Objectives of the Thesis:
This thesis aims to collect the jurisprudential issues that have multiple opinions within the same school, particularly those discussed between the chapter of disagreement between contracting parties and the perishing of the sold item up to the chapter of pledge in al-Bayan by al-‘Umrani. The purpose is to provide jurists with access to a wide range of opinions within the Shafi‘i school, supported by evidence and legal reasoning, given the abundance of contributors in the school of Imam al-Shafi‘i (may Allah have mercy on him). The study also seeks to compare these opinions with those of other schools of jurisprudence.
Key Findings:
The study reached several conclusions, the most significant of which is that al-Bayan is one of the most important works dedicated to transmitting the multiple opinions within jurisprudential issues. Furthermore, the existence of diverse opinions is not a sign of contradiction but rather a means of expanding the scope of ijtihad in jurisprudential matters.
Following the in-depth deliberations of the examining committee, the thesis was approved with a grade of “Pass with Fulfillment.”
