Master’s Thesis Defense
Under the patronage of the respected President of the University of Fallujah, Prof. Dr. Ahmed Suleiman Hamad, and under the supervision and follow-up of the respected Dean of the College of Islamic Sciences, Prof. Dr. Mohammed Jassim Abdul, the public defense of the Master’s student Qasim Mahmoud Abdulhadi, from the Department of Sharia – College of Islamic Sciences / University of Fallujah, was held at noon on Thursday, August 21, 2025, for his thesis entitled:
“The Jurisprudential Issues with Two Opinions among the Shafiʽi Scholars in al-Bayan by al-‘Imrani (d. 558 AH), from the Book of Qirad to the Book of Ijara, and Their Impact on the Fatwas of Contemporary Scholars – A Comparative Study.”
The defense took place in the central hall of the College of Islamic Sciences.
The examining committee consisted of the following professors:
- Prof. Dr. Majid Saleh Ibrahim – Chair
- Asst. Prof. Dr. Ahmed Diaauddin Shakir – Member
- Asst. Prof. Dr. Mohammed Hussein Ouda – Member
- Prof. Dr. Mohammed Ahmed Matar – Member and Supervisor
Objectives of the Thesis:
This thesis aims to collect the jurisprudential issues that have multiple opinions within the same school of thought, specifically those found between the Book of Qirad and the Book of Ijara in al-Bayan by al-‘Imrani. The goal is to enable jurists to access a vast body of opinions within the Shafiʽi school, investigate the supporting evidences, and present different views, given the large number of opinion-holders in the school of Imam al-Shafiʽi (may Allah have mercy on him). The study also compares these with the views of other schools of law.
Main Findings:
The study reached several conclusions, most notably:
- al-Bayan is considered one of the most important works that paid attention to reporting the multiple opinions on jurisprudential issues.
- The diversity of opinions and views serves as a means of broadening the horizons of juristic reasoning in legal matters.
After an in-depth discussion by the examining committee, the thesis was accepted with the grade of “Satisfactory.”
