“The Jurisprudential Issues with Two Views among the Shafi‘i Scholars in Al-Bayan by al-‘Imrani (d. 558 AH) in the Book of Pre-emption and Their Impact on Contemporary Fatwas – A Comparative Study.”
The defense took place in the Central Hall of the College of Islamic Sciences.
The examination committee consisted of the following professors:
Prof. Dr. Ali Hussein Abbas – Chair
Prof. Dr. Othman Faleh Hassan – Member
Assoc. Prof. Dr. Mohammed Abdulrazzaq Mahmoud – Member
Assoc. Prof. Dr. Mohammed Hadi Talal – Member & Supervisor
Objectives of the Thesis:
This thesis aims to collect the jurisprudential issues with multiple views within the same school, particularly those related to the Book of Pre-emption in Al-Bayan by al-‘Imrani, in order to provide jurists with access to a large corpus of differing opinions within the Shafi‘i school, examine their evidences, and present their arguments. This is due to the abundance of variant views within the school of Imam al-Shafi‘i (may Allah have mercy on him), which can then be compared with the opinions of other schools.
Key Findings:
The study reached several findings, the most significant of which is that Al-Bayan is one of the most important works dedicated to transmitting multiple views on jurisprudential issues. Furthermore, the variation of opinions and perspectives serves as a means of expanding the horizons of ijtihad in jurisprudential matters.
After extensive discussion of the thesis topic by the committee members, the thesis was approved with a grade of “Satisfactory” (Mustawfī).
