Master’s Thesis Defense on Jurisprudential Issues with Two Opinions in the Shafi‘i School of Thought
Under the patronage of the respected President of the University of Fallujah, Prof. Dr. Ahmed Suleiman Hamad, and under the supervision and follow-up of the respected Dean of the College of Islamic Sciences, Prof. Dr. Mohammed Jassim Abdul, the public defense of the master’s student Yaseen Talib Fureih from the Department of Sharia – College of Islamic Sciences / University of Fallujah, was held on the morning of Sunday, August 31, 2025, for his thesis entitled:
“Jurisprudential Issues with Two Opinions in the Shafi‘i School in al-Bayan by al-‘Imrani (d. 558 AH) from the Book of Ijarah and Their Impact on Contemporary Fatwas – A Comparative Study.”
The defense took place in the central hall of the College of Islamic Sciences.
The examination committee consisted of the following professors:
- Prof. Dr. Mohammed Jassim Abdul – Chair
- Assoc. Prof. Dr. Omar Hassan Ali – Member
- Assoc. Prof. Dr. Mahmoud Khalaf Hammadi – Member
- Prof. Dr. Majeed Saleh Ibrahim – Member and Supervisor
Objectives of the Thesis:
The thesis aims to compile jurisprudential issues with multiple opinions within the same school, focusing on the issues in the Book of Ijarah in al-Bayan by al-‘Imrani. This provides jurists with access to a vast number of opinions within the Shafi‘i school, enabling them to examine the evidences and present views—given the abundance of authorities (ashab al-wujuh) in the Shafi‘i school—before comparing them with the opinions of other schools of jurisprudence.
Key Findings:
The study reached several conclusions, the most important of which are:
- Al-Bayan is one of the most important works that preserved and transmitted the various opinions on jurisprudential issues.
- The diversity of opinions and views serves as a means to broaden the horizons of ijtihad in jurisprudential matters.
After extensive discussion by the committee members, the thesis was accepted with a grade of “Pass with Distinction.”
